Mediation is not arbitration and certainly not therapy. Our business mediators do look for underlying beliefs that stand in the way of an immediate resolution of the conflict. There may also be strong emotions involved. Those blocking issues are identified and addressed as necessary and useful for a good outcome.

Our people

Our mediators are seasoned in business and banking, with extensive experience in entrepreneurship, legal (domestic and international), general lending and structured finance.

Our way of working

In an initial intake, we get to know each other and hear from each party individually about the business disputes at hand. We work with you to determine who needs to come to the table to resolve those disputes. Sometimes advisors such as the accountant, lawyer or in-house counsel also join the joint sessions. After the table setting and agenda are determined, we will begin the joint discussions, where you can expect us to lead a balanced and effective mediation process in our role as neutral and impartial mediator(s). Generally, they require three to four two-hour joint sessions to reach a lasting solution. The result is usually recorded in writing in a settlement agreement.

That process takes two to six weeks, depending on the complexity of the case and availability of clients and their counsel.

Mediation in one day

If desired, we also offer one-day mediation. In doing so, all parties and their advisors make themselves available throughout the day at a neutral meeting location. Joint and separate discussions are held there with the mediator. It is important to enter into such a mediation with the mandate to reach binding agreements.
